For a settlement agreement to be legally binding an employee must seek independent legal advice on its terms. An employer will usually contribute towards an employee’s legal fees incurred in connection with advice received on the settlement agreement and termination of the employment. Payment is usually made direct from the employer to the employee’s legal adviser upon receipt of an invoice.
